Lani will review the ongoing statewide moratorium in Florida on newly-enrolling home health agencies in Medicare, Medicaid, and CHIP, and the Centers for Medicare & Medicaid Services' (CMS) recently-revised Access Waiver Demonstration. CMS has revised the demonstration to waive certain requirements under the 21st Century Cures Act, to enable providers to receive Medicare, Medicaid, and CHIP payment for items and services within the provider’s approved service area for the demonstration. Some providers not previously able to benefit from the demonstration may now qualify based on the revised provisions, and may be able to apply to CMS for the waiver. Gleaned from thousands of appeals and hundreds of hearings, we will address the appeal process, preparation, and presentation tips for ALJ hearings to push you towards success, including laying the groundwork during the entire Medicare appeals process to build toward a winning presentation. This also includes guidance on writing lower level appeals that both support payment at earlier levels and build a strong foundation for the hearing. For the ALJ hearing, it introduces procedural documents, administrative tasks prior to the hearing, how to prepare for the hearing, and presentation pointers to maximize the chance for a successful outcome.
